Employment Law

Throughout the UK employment law is becoming increasingly complex and ever changing. A dispute involving one person can potentially affect thousands of employees in the same industry.

At Francis Alexander Solicitors we will aim to provide you with specialist advice, assistance and if necessary offer representation. We have worked closely with the GMB UNION and we are members of the EMPLOYMENT LAWYERS ASSOCIATION.We can help in relation to the following:

  • Unfair and wrongful dismissal claims
  • Breach of employment contract
  • Redundancy and related matters
  • Working hours and holiday entitlement
  • Parental leave and time off for dependants
  • Transfer of a business - the effect upon employees and obligations on the part of employers
  • Discrimination due to Sex, Race, Disability, Religion or sexual orientation
  • Equal pay and minimum wage claims
  • Sexual Harassment and Victimisation in the work place
  • Compromise agreements
  • Protected awards.
  • Group Actions

The amount of payment you are entitled to will be based upon:

  • Time you have worked for your employer and your age.
  • Your weekly pay limited to the maximum set by the Government and reviewed each year.
  • The minimum required under the National Minimum Wage Regulations.

The main compensation you can claim is:

  • Wages you are owed
  • Holiday pay you are owed
  • Compensation for pay you have lost through not being given the proper period of notice; and
  • A redundancy payment, if you qualify.

Where employment disputes do arise, we aim to resolve these through negotiation or mediation with the aim of making a Compromise Agreement. If the other side does not show willingness to resolve matters we will persevere with the case, whether in court, the Employment Tribunal or at the negotiating table.

We have acted for Major Trade Unions on various aspects of Employment related cases and refer you to our other page in relation to specific cases.

Case Study

Jane had worked as a cleaner for the same company in Manchester City Centre for over 15 years. The work was seasonal and she would not work throughout the summer holidays, and then be taken on every September again by the same company on a new contract.

“It suited me fine. I could spend extra time with the kids during the summer holidays and we could take a weekend away as a family at any time we wanted during the summer break.”

When Jane was working in spring 2005 she heard rumours that some of the cleaning staff were going to be made redundant. She was never consulted or told anything.

“They just gave me my last pay packet and said they would not be re-hiring me after the summer break, as the cleaning had been outsourced to a specialist cleaning company. They had the cheek to tell me that perhaps I should ring up and ask if they had any jobs going. I asked about redundancy pay, but they said that because of the break I had technically only worked there since September 2004, and I wasn’t entitled to any redundancy pay. After 15 years service I was devastated. I just left without saying a word as I didn’t know whether what they had told me was true”

Employment law can be a very complicated area. Often people are worried about losing their job if they bring a claim or make a complaint. That’s why you need specialist advice from the outset from a firm of solicitors who specialise in employment law.

Employment law has expanded greatly in recent years and sometimes your employment rights may be breached unknowingly by your employer. Similarly you may not know that your rights have been breached until you speak to a specialist. We understand that you might want to stay on in your job, and if correct procedures are followed there is no reason why you can’t enforce your statutory rights and keep your job. That’s why you need to consult a specialist employment solicitor like Francis Alexander.

Jane consulted Francis Alexander, who took on her case on a ‘No win no fee basis, on a contingency contract and Jane didn’t have to pay anything for their services. They helped Jane get the redundancy pay and Payment In Lieu of Notice that she never received. Jane received over £1000.
